
JEPH and Leo (Private) Limited company and its director Jephrate Muzira were yesterday found guilty of defrauding Geo Pomona Waste Management (Pvt) Limited of US$37 265.
Muzira (60) and his company were convicted by Harare magistrate Rufaro Panavanhu after a full trial before the matter was deferred to today for sentence.
The court heard that sometime in March last year, the complainant advertised a tender for procurement of pebble stones.
Muzira responded to the advertisement and was awarded the tender to supply 1 500 cubic metres of pebble stones worth US$62 531 to the complainant, which was to be delivered by April 25, 2024.
On March 2, 2024, the complainant transferred US$31 265 into the company’s ZB Bank account as initial deposit for the material. During the same month, Muzira supplied 114 cubic metres of pebble stones to the complainant and was left with an outstanding balance of 1 386 cubic metres of pebble stones valued at US$37 265, 63.
On April 23, 2024, Muzira requested a further payment of US$10 000 from the complainant to facilitate the delivery of outstanding pebble stones by April 27, 2024.
Complainant transferred US$10 000 into Muzira’s ZB Bank account number.
When the delivery day arrived, the complainant made a follow-up for the outstanding pebble stones, but Muzira kept on giving empty promises and failed to deliver the stones to the complainant.
