Katsimberis fraud  trial fails to kick

The fraud trial of property developer George Katsimberis who is accused of building a showroom in Borrowdale using an unapproved building plan has been postponed for the umpteenth time after his lawyer indicated that he was not feeling well.

Katsimberis is represented by advocate Tino Chinyoka.

But Prosecutor General Micheal Reza has accused Katsimberis of buying time saying the fraud trial might not finish during his lifetime due to postponements.

Responding to the submissions by advocate Chinyoka, Reza said the history of this case is littered with postponements.

"With the pace we are going with this matter I don't think we would be able to finish it during our lifetime," he said.

Reza however said he had no reason to doubt that the defence is unwell.

Harare magistrate Vongai Guwuriro deferred the matter to August 10.

During the last sitting Katsimberis's second bid  to have the services of a Greek interpreter hits another brick wall after it was dismissed.

Katsimberis who has been in and out of courts following all proceedings in English had applied the services of a Greek interpreter in making an application for referral to the Apex Court of his matter.

In dismissing the application Harare magistrate Guwuriro said the application was now functus officio meaning she cannot hear the same application for the second time.

"This court has become functus officio therefore the application is herby dismissed," she said.
